Straight answers,
no hedging
The two questions that stop most people from calling are what it costs and how long they have. Both are answered first, in plain numbers.
The general ones
What does it cost to hire you?
Nothing up front and nothing if we lose. Our fee is 33.3 percent of the recovery if the case resolves before a lawsuit is filed and 40 percent after that, because a filed case costs a great deal more to run. Case expenses come out of the recovery, not out of your pocket, and if there is no recovery you owe us nothing at all, including expenses.
How long do I have to bring a claim in Arizona?
Two years from the date of injury for most personal injury and wrongful death claims. If a city, county or state entity is involved, you must serve a notice of claim within 180 days, which is the deadline that quietly kills more cases than any other. Claims on behalf of a child are generally paused until they turn 18. Call before you assume you are out of time.
Do I have to go to court?
Probably not. Around 92 percent of our cases resolve without a trial. What changes the outcome is whether the other side believes we are willing and able to try it, which is why we prepare every file as though it is going in front of a jury.
The insurance company already offered me money. Should I take it?
Not before someone independent has valued your claim. Early offers are made while your treatment is incomplete, and accepting one closes the claim permanently, including for injuries nobody has diagnosed yet. A review costs you nothing and takes about twenty minutes.
What if the crash was partly my fault?
Arizona uses pure comparative fault, so you can recover even if you were substantially at fault. Your recovery is reduced by your percentage of responsibility. Being told by an adjuster that you were at fault is a negotiating position, not a legal finding.
How long will my case take?
Straightforward claims often resolve in six to nine months. Catastrophic and wrongful death cases usually run 18 to 30 months, because a credible valuation needs a physician willing to state a permanent prognosis. We will give you an honest range at the first meeting and update it as things change.
Do you speak Spanish?
Yes. Two of our four attorneys and most of our intake and case management team are fully bilingual. You will never be handed a phone interpreter or asked to bring a family member to translate.
What should I do right now, today?
Get medical attention and follow the treatment plan. Photograph everything including your injuries as they change. Do not give a recorded statement to any insurer. Do not post about the crash. Then call us, because evidence such as vehicle data, dashcam footage and surveillance video is routinely destroyed within thirty days.
By practice area
Car accidents
What if the other driver had no insurance?
Your own uninsured and underinsured motorist coverage is usually the answer, and it is a benefit you already paid for. We open that claim for you and handle your own insurer, who is not automatically on your side once money is involved.
My car was barely damaged. Do I still have a case?
Yes. Low property damage is the single most common argument insurers use to deny real injuries, and biomechanical evidence routinely defeats it. Vehicle damage measures the vehicle, not the spine.
Truck accidents
The police report blamed the driver. Is my case simple now?
No. A police report is an opinion, it is frequently inadmissible at trial, and carriers routinely retain experts to contradict it. It helps, and it settles nothing on its own.
Can I sue the company and not just the driver?
Usually yes. Negligent hiring, negligent retention, negligent supervision and unsafe dispatch practices are direct claims against the carrier, and they are where the meaningful coverage lives.
Catastrophic injury
How long will a catastrophic case take?
Usually 18 to 30 months. The single biggest driver is medical stability, because a credible life care plan requires a physician willing to state a permanent prognosis. Settling before that point costs clients more than the delay ever does.
Can we get money before the case resolves?
Often yes. Medical payments coverage, health insurance coordination and, where appropriate, litigation funding can carry a family through. We do this early because financial pressure is the most reliable tool the defence has.
Wrongful death
Will we have to testify about our loss?
Sometimes, and we prepare families for it carefully. In most cases the testimony that matters is short, and much of the record is built through friends, coworkers and teachers instead.
What if our family member was partly at fault?
Arizona uses pure comparative fault, so a claim survives even at high percentages of fault and the recovery is reduced proportionally. Do not assume a case is gone because someone told you it is.
