Catastrophic injury
in Phoenix

A catastrophic case is not a bigger version of an ordinary case. The number that matters is not what was spent last year. It is what the next forty years will cost, and almost nobody calculates that correctly the first time.

$47.8MLife care plan secured for a client aged 31

What goes wrong before anyone calls a lawyer

  1. The number is settled too early

Families accept before the treating team can state a prognosis, and permanent needs get priced as temporary ones.

  2. Home and vehicle modification gets forgotten

Ramps, a roll-in shower, doorway widening, an adapted van and a replacement van every eight years are real costs that adjusters simply omit.

  3. Attendant care is undercounted

Family members provide unpaid care that has genuine market value, and that value is compensable. It is almost never in the opening offer.

What this office does instead

Three moves, in this order, on every file of this kind.

Your deadline

Two years from injury. Claims for a minor are generally tolled until they turn 18.

  • A certified life care plan

A nurse life care planner and a physiatrist build a year-by-year schedule of care, equipment, therapy and medication for the client's full life expectancy.

  • Economists, not estimates

A forensic economist reduces that plan to present value and quantifies lost earning capacity against the client's actual career trajectory.

  • Structured settlements done properly

We coordinate with settlement planners and special needs trust counsel so a recovery does not disqualify the client from the benefits they depend on.

Catastrophic injury questions

How long will a catastrophic case take?

Usually 18 to 30 months. The single biggest driver is medical stability, because a credible life care plan requires a physician willing to state a permanent prognosis. Settling before that point costs clients more than the delay ever does.

Can we get money before the case resolves?

Often yes. Medical payments coverage, health insurance coordination and, where appropriate, litigation funding can carry a family through. We do this early because financial pressure is the most reliable tool the defence has.

What does it cost to hire you?

Nothing up front and nothing if we lose. Our fee is 33.3 percent of the recovery if the case resolves before a lawsuit is filed and 40 percent after that, because a filed case costs a great deal more to run. Case expenses come out of the recovery, not out of your pocket, and if there is no recovery you owe us nothing at all, including expenses.

How long do I have to bring a claim in Arizona?

Two years from the date of injury for most personal injury and wrongful death claims. If a city, county or state entity is involved, you must serve a notice of claim within 180 days, which is the deadline that quietly kills more cases than any other. Claims on behalf of a child are generally paused until they turn 18. Call before you assume you are out of time.
